Riley Charged After McDonald’s Incident

A 54-year-old Owsley County man was arrested on Sunday after being removed from McDonald’s by the Jackson Police Department.

Gary L. Riley, of Moores Branch near Lerose, was arrested on May 3 and charged with one count of Public Intoxication Controlled Substance (excludes Alcohol) and one count of Criminal Littering.

According to police reports, Jackson Police Officers were called to the restaurant at 8:25 Sunday night after the staff reported a man possibly under the influence and smoking in the building.  He reportedly refused to leave.

When officers arrived, they located Riley.  He was “observed to be manifestly under the influence of a controlled substance.”

Officers observed Riley throw a cigarette on the ground as he exited the building.

They determined that he was a “danger to himself and others” and was placed under arrest by Officer Jeramie Long at 9:58 p.m.

Riley was transported to the Kentucky River Regional Jail in Hazard by the Breathitt County Jailer and lodged at 11:23 p.m. on Sunday.  He was released at 7:44 a.m. on May 4, pending his appearance in Breathitt District Court before Judge Gary Salyers.
